Michigan has an adult-use and medical cannabis program

Retail licensing and advertising rules are enforced by the Cannabis Regulatory Agency. For billboards, social media and other channels, see our cannabis advertising rules beyond texting.

These Michigan rules bear on texting customers

Adult-use products may not be marketed to anyone under 21, and medical products must be marketed as medical marihuana for registered patients and caregivers only.

  • Mich. Admin. Code R 420.507(4) prohibits advertising or marketing a marihuana product to the public unless the advertiser has reliable evidence that no more than 30% of the audience of the program, website or publication is reasonably expected to be under the applicable minimum age.
  • Any marihuana product that is advertised or marketed must include the warnings listed in the packaging and labeling rule (Mich. Admin. Code R 420.507(4)).
  • The referenced warnings include a statement that driving under the influence is illegal, the National Poison Control Center number, an age or patient-only statement, and a pregnancy and breastfeeding warning (Mich. Admin. Code R 420.504(1)(j)).
  • Products marketed under the adult-use act must be marketed as "marihuana" for use only by individuals 21 or older and must not be marketed to anyone under 21, and sponsorships targeting people under 21 are prohibited (Mich. Admin. Code R 420.507(8) and (9)).
  • Products marketed under the medical facilities act must be marketed as "medical marihuana" for use only by registered qualifying patients or caregivers, and must not be marketed to minors aged 17 or younger (Mich. Admin. Code R 420.507(6) and (7)).
  • Mich. Admin. Code R 420.507(2) prohibits advertising a marihuana product in a way that is deceptive, false or misleading.
  • Marketing and advertising must not contain health or health benefit claims unless the claim has FDA enforcement discretion or FDA approval under the significant scientific agreement standard (Mich. Admin. Code R 420.507(3)).
  • Advertising and marketing must also comply with all applicable municipal ordinances and state law that regulate signs and advertising (Mich. Admin. Code R 420.507(1)).
  • Text only people who opted in, and keep the record of when and how they did. Our guide to SMS opt-in and consent for dispensaries covers what to record.
  • Put your store name first and an opt-out line on every text.
  • Keep product details, prices and offers on an age-gated page rather than in the text, and check the wording against our list of banned words in cannabis texts.
