Sticky Cards

Text your customers within Mississippi’s cannabis advertising rules

Mississippi dispensaries must follow the State Department of Health advertising rules, which prohibit advertising and marketing in any media, naming mass text messaging and mass email among the banned forms. The rules separately allow inducements such as discount cards, coupons, punch cards and deal discounts, and treat risk and benefit education for patients as outside advertising.

  • The Department of Revenue rule allows dispensaries to use inducements such as discount cards, coupons, punch cards, buy one get one offers and daily, weekly or monthly deal discounts, provided they do not push use beyond practitioner limits or legal amounts (Miss. Admin. Code 35.XI.13.100).
  • 15 Miss. Admin. Code Pt. 22, R. 9.4.1 states that risk and benefit education between an establishment and a qualified patient, caregiver, parent or legal guardian is not considered advertising or marketing.
  • Text only people who opted in, and keep the record of when and how they did. Our guide to SMS opt-in and consent for dispensaries covers what to record.
  • Put your store name first and an opt-out line on every text.
  • Keep product details, prices and offers on an age-gated page rather than in the text, and check the wording against our list of banned words in cannabis texts.
