Sticky Cards

Text your customers within Missouri’s cannabis advertising rules

Missouri defines advertisement to include email, texting and mobile applications, so a dispensary's marketing texts fall under the same content rules as other advertising. Those rules bar false or misleading statements, unapproved curative or therapeutic claims, and content attractive to children, and the state constitution caps advertising regulation at the stringency of comparable alcohol rules.

These Missouri rules bear on texting customers

  • 19 CSR 100-1.010(3) defines advertisement to include dissemination of information by email, texting, websites, mobile applications or any electronic means.
  • 19 CSR 100-1.100(5)(A) requires marijuana product advertising and marketing to comply with all applicable municipal ordinances, state law and rules regulating signs and advertising.
  • 19 CSR 100-1.100(5)(B)1. prohibits any advertisement of marijuana containing a false or misleading representation.
  • 19 CSR 100-1.100(5)(B)2. prohibits advertising statements that marijuana has curative or therapeutic effects unless the statement has been evaluated and approved by the Food and Drug Administration.
  • 19 CSR 100-1.100(5)(B)3. prohibits advertising content that is attractive to children, including animal, fruit or cartoon human shapes.
  • 19 CSR 100-1.100(5)(B)4. prohibits advertising statements about a marijuana brand that are inconsistent with the product labeling.
  • 19 CSR 100-1.100(5)(D) prohibits exterior signage or advertising that does not accurately reflect the licensee's legal name, business name, d/b/a or trade name on record with the department.
  • The state constitution authorizes the department to regulate the advertising and promotion of marijuana sales, but no more stringently than comparable state rules for alcohol (Mo. Const. art. XIV, sec. 2.4(1)(n)).
  • 19 CSR 100-1.180(2)(D)2.F. requires dispensaries to record every disbursement of marijuana product in the statewide track and trace system, including when prices are discounted or waived.
  • Text only people who opted in, and keep the record of when and how they did. Our guide to SMS opt-in and consent for dispensaries covers what to record.
  • Put your store name first and an opt-out line on every text.
  • Keep product details, prices and offers on an age-gated page rather than in the text, and check the wording against our list of banned words in cannabis texts.
