Text your customers within Vermont’s cannabis advertising rules
Vermont treats any message that tends to induce sales as advertising, so promotional texts must carry the Board's full health warning, meet the 15 percent under-21 audience rule, and be submitted to the Board before sending unless they follow an approved template.

These Vermont rules bear on texting customers
Board guidance allows texts and emails only to age-verified customers who signed up inside the store and expressly consented, and the Board's advertising inbox must receive a copy of every message sent.
- Advertising covers any statement that would reasonably induce sales, including internet and any other media (7 V.S.A. 861(2)).
- Texts and emails only to age-verified customers who signed up in store and expressly consented (CCB Advertising Guidance (January 2026), Email, Text, Social Media DMs & Messaging Platforms).
- The Board's advertising address must be copied on every text or email advertisement (CCB Advertising Guidance (January 2026), Copying the CCB).
- All advertisements must be submitted to the Board before dissemination (7 V.S.A. 864(e)).
- Audience composition: no more than 15 percent reasonably expected to be under 21 (7 V.S.A. 864(c)).
- Mandatory Board health warning on all marketing and advertising, reproduced exactly (CCB Rule 2.2.10(a)).
- No curative claims and no offers of free samples (7 V.S.A. 864(b)(3) and (5)).
- No content likely to appeal to anyone under 21 (CCB Rule 2.2.11(a)).
- Ordinary discounts and loyalty pricing are permitted if otherwise lawful (CCB Advertising Guidance (January 2026), Giveaways and Free Samples).
- Promotional texts go to the Board for review before sending, unless they follow a Board-approved template (CCB Advertising Guidance (January 2026), Email, Text, Social Media DMs & Messaging Platforms, and footnote 2).
Start with consent, your store name and an opt-out line
- Text only people who opted in, and keep the record of when and how they did. Our guide to SMS opt-in and consent for dispensaries covers what to record.
- Put your store name first and an opt-out line on every text.
- Keep product details, prices and offers on an age-gated page rather than in the text, and check the wording against our list of banned words in cannabis texts.
Sticky SMS, by Sticky Cards, the loyalty and marketing platform for cannabis dispensaries, files your 10DLC registration with The Campaign Registry, with no charge for the number or the registration, and most stores are live in 1 to 2 days. How Vermont’s rules apply to your program stays with you and your counsel.
